Welcome to Amazing Water Inc. ("Company," "we," "us," or "our"). By accessing or using our website amazingh2o.ca (the "Site") and purchasing our products, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully.

1. General Terms

1.1 Acceptance of Terms

These Terms constitute a legally binding agreement between you and Amazing Water Inc. Your use of the Site and purchase of products indicates your acceptance of these Terms, along with our Privacy Policy and other policies referenced herein.

1.2 Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use after changes constitutes acceptance of the modified Terms. We recommend reviewing this page periodically.

1.3 Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use this Site and purchase products. By using the Site, you represent that you meet these requirements.

2. Product Information

2.1 Product Descriptions

We strive to provide accurate product descriptions, specifications, and images. However:

• Colors may vary due to monitor settings
• Specifications are subject to change without notice
• We do not warrant that descriptions are error-free or complete

2.2 Product Availability

All products are subject to availability. We reserve the right to:

• Discontinue products at any time
• Limit quantities per customer
• Cancel orders if products become unavailable after purchase

2.3 Pricing

All prices are listed in USD or CAD (as indicated) and are subject to change without notice. We reserve the right to correct pricing errors on our Site or orders. If a pricing error occurs, we will contact you before processing your order.

3. Orders and Payment

3.1 Order Acceptance

Your order is an offer to purchase products. We reserve the right to accept or decline any order for any reason, including:

• Product availability
• Errors in pricing or product information
• Suspected fraudulent transactions
• Failure to meet credit authorization requirements

An order confirmation email does NOT constitute acceptance. Acceptance occurs when we ship your order.

3.2 Payment Processing

Payment is due at the time of order. We accept:

• Major credit cards (Visa, Mastercard, American Express)
• PayPal (where available)

Payment processing is handled by third-party payment processors. By providing payment information, you authorize us to charge the full order amount, including products, shipping, and applicable taxes.

3.3 Sales Tax

Applicable sales taxes (GST, HST, PST, or state sales tax) will be calculated and added to your order based on your shipping address. You are responsible for all taxes and duties.

4. Shipping and Delivery

4.1 Shipping Policy

We offer free shipping to addresses in the United States and Canada (excluding remote/rural areas). Shipping times vary by location:

• Standard Shipping: 5-10 business days
• Expedited Options: Available at checkout (additional fees apply)

Shipping times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or force majeure events.

4.2 Shipping Restrictions

We currently ship only to the United States and Canada. We do not ship to:

• PO Boxes (signature required for delivery)
• International addresses outside US/Canada
• APO/FPO/DPO addresses

4.3 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the carrier. We recommend insuring high-value shipments.

5. Returns and Refunds

6. Warranty and Product Support

6.1 Limited Warranty

Amazing Water systems are covered by a 3-Year Limited Warranty against manufacturing defects. The warranty covers:

• Stainless steel housing and components
• UV sterilization system
• Faucet and fittings

NOT covered:

• Filter cartridges (normal wear items)
• Damage from improper installation, misuse, or neglect
• Cosmetic damage (scratches, dents)
• Damage from freezing, fire, or natural disasters

6.2 Warranty Claims

To make a warranty claim:

1. Contact us at info@amazingh2o.ca with your order number and issue description
2. Provide photos/videos of the defect if requested
3. Ship the defective product to us (return shipping paid by us for valid claims)
4. We will repair, replace, or refund at our discretion

6.3 Filter Replacement

Filter cartridges should be replaced every 8,000 gallons or 12-18 months, whichever comes first. Failure to replace filters may void your warranty.

7. Health and Safety Disclaimers

7.1 Water Quality

Our systems are designed to filter municipal tap water meeting WHO standards. If your source water is from a well or contains unusual contaminants, contact us before purchase to ensure compatibility.

7.2 Installation

Improper installation may damage the system or void the warranty. If unsure, hire a licensed plumber. We are not responsible for installation errors or resulting damage.

7.3 Medical Advice

Consult your healthcare provider before making significant dietary changes, including switching to alkaline water, especially if you have kidney disease, heart conditions, or take medications affected by mineral intake.

8. Intellectual Property

8.1 Trademarks and Copyrights

All content on this Site, including text, graphics, logos, images, and software, is the property of Amazing Water Inc. or its licensors and is protected by copyright and trademark laws.

8.2 Permitted Use

You may view and download content for personal, non-commercial use only. You may NOT:

• Reproduce, distribute, or display content for commercial purposes
• Modify or create derivative works
• Remove copyright or trademark notices
• Use automated systems (bots, scrapers) to access the Site

9. Limitation of Liability

9.1 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Site and products are provided "AS IS" and "AS AVAILABLE"
• We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement
• We do not warrant that the Site will be error-free, uninterrupted, or secure

9.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Amazing Water Inc. SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage related to product use

Our total liability to you for any claim shall not exceed the amount you paid for the product giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Amazing Water Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your misuse of products
• Your violation of any third-party rights
• Your violation of applicable laws

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. For US customers, the laws of the state where you reside may also apply.

11.2 Arbitration Agreement

Any dispute arising from these Terms or your purchase shall be resolved through binding arbitration rather than in court, except you may assert claims in small claims court if they qualify.

Arbitration Rules:

• Administered by the British Columbia International Commercial Arbitration Centre (BCICAC) for Canadian customers
• American Arbitration Association (AAA) for US customers
• One arbitrator, decision is final and binding
• Each party pays their own legal fees

11.3 Class Action Waiver

You agree to bring claims only in your individual capacity, NOT as part of a class action, collective action, or representative proceeding.

12. Miscellaneous

12.1 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full effect.

12.2 Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Amazing Water Inc. regarding your use of the Site and purchase of products.

12.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

12.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
